‘GRAM’ Trademark Faces Lawsuit from TelegramDavid Kemp

As many mass media outlets have recently mentioned, Telegram decided to drop a lawsuit over ‘GRAM’ trademark. There are a lot of details and nuances lawyers find important and one of them is that the service will have to cover the legal fees.
To some users, it looks unexpected that the famous platform would drop a two-year-old lawsuit. They are doing it to prevent others from using the trademark that many associate with the service. The part that accompanies the process is that the team will be fully responsible for repaying the costs of the legal processes of the defendant.
Many specialists involved in the issue state that the brand has finally dismissed its lawsuit. They did it voluntarily. As crypto analysts say, the lawsuit was dropped due to the fact that Lantah intended to use the famous trademark. The former’s intention was to give the same name to its token.
Judges ruled that the messenger must be obliged to repay relatively reasonable fees to the defendant. Recent data shows that the lawsuit first appeared two years ago and the team will have to cover the costs that the process lasting for the past two years has required.
Negotiations for a Reasonable Sum
No doubt, the process has taken quite a long time. There were plenty of professionals involved in various procedures required for this sort of lawsuits. The press confirms that Lantah hasn’t yet submitted any official records and there is no documentation as to how much the legal procedure cost.
At present, judges announce that the two parties will need to negotiate and decide on a reasonable amount of money the messenger’s team would repay to cover all expenses. Official representatives dismissed the lawsuit – there was no prejudice to refilling. This, in turn, allowed the platform to make several claims over its trademark.
Lantah sent a request fordismissal with prejudice, but the team found it necessary to reject it. First, three months ago the messenger’s project was abandoned. After this step, the brand dropped the lawsuit. Their next move was to settle with the U.S. authorities and Commission in the beginning of this summer. The fact that many analysts pay attention to is that the messenger’s team announced its intention to sponsor the launch of a blockchain network. Their plan was to do it through the sale of their native tokens three years ago.
Lantah, on the other hand, had formed a few months before this event. Their team had already arranged a plan to launch a cryptocurrency named ‘GRAM’ and they had no idea that would cause so much trouble a few months later.
Also, sources confirm that Lantah had managed to submit an application regarding the name by 2018. However, the messenger took legal action against it in the spring after collecting almost two billion USD – that was done thanks to a three-month offering of the mentioned brand’s token.
Counterclaims were filed. Documents proved that Lantah has the right to use the name since it had priority over it. Nevertheless, the judges granted the messenger’s request. That was a preliminary injunction that barred the company from employing the trademark. They also noted that the messenger’s platform had started utilizing it within a commercial context before it was performed by Lantah.
